These Terms & Conditions ("Terms") govern the purchase of original artwork ("Artwork") from Gerald Fracareta ("Seller", "we", "us", or "our"). By purchasing Artwork from us, you ("Buyer", "you", or "your") agree to be bound by these Terms.
1. ORIGINAL ARTWORK
– All artworks sold are original creations by the artist, and each piece is unique.
– Details such as dimensions, medium, and date of creation are provided in the listing.
2. NON-REFUNDABLE SALES
– All sales are final. Due to the unique and original nature of the Artwork, no refunds, returns, or exchanges will be accepted once the transaction is completed.
– We encourage you to review all descriptions thoroughly and/or to contact us with questions or to request additional images before purchasing.
3. PAYMENT
– Full payment is required at the time of purchase.
– Accepted payment methods include debit and credit cards.
– Ownership of the artwork transfers to the Buyer only after full payment is received.
4. SHIPPING & DELIVERY
– Shipping costs will be calculated at checkout unless otherwise specified.
– Artworks are carefully packaged to ensure safe delivery. We are not liable for any damage occurring during transit but will assist with claims if applicable.
– Please allow 5-7 business days for handling before shipment.
5. DAMAGED OR LOST ITEMS
– If your artwork arrives damaged, notify us immediately with photographic evidence.
– Lost shipments will be handled in coordination with the shipping carrier, but we are not liable for delays or failures caused by third-party services.
6. INTELLECTUAL PROPERTY
– Purchase of the Artwork does not include any rights to reproduce, distribute, or create derivative works.
– Copyright remains with the artist unless a separate written agreement transfers such rights.
7. EXHIBITIONS & ARTIST RIGHTS
– The artist retains the right to use images of the Artwork for portfolios, marketing, and exhibition purposes even after the sale.
– Buyer agrees not to distort, alter, or resell the Artwork under the artist's name in a misleading way.
8. GOVERNING LAW
– These Terms shall be governed by and construed in accordance with the laws of the state of Rhode Island, USA.
– Any disputes shall be resolved in the courts of Providence county.
9. AMENDMENTS
– We reserve the right to update these Terms & Conditions at any time. The version in effect at the time of purchase will govern that sale.
